Dayton Campus SSI Survey Sweepstakes Official Rules
These Official Rules apply to the Wright State University Dayton Campus Student Satisfaction Inventory (SSI) Survey Sweepstakes (the “Event”). By participating in the Event, each participant agrees to be bound by these Official Rules.
- Event Details. The Wright State University Dayton Campus SSI Survey Sweepstakes (the “Event”) is sponsored by Wright State University (the “University”), 3640 Colonel Glenn Highway, Dayton, Ohio 45435. The Event is subject to, and will be exclusively construed in accordance with the applicable internal laws of the state Ohio, without consideration of any choice of law principles. The Event shall be void where prohibited. No purchase is necessary to participate. Odds of winning are determined by the number of entrants.
- Entry Period. The Event begins on March 6, 2024, at 12:01 a.m. Eastern Time (“ET”), and ends on April 20, 2024, at 11:59 p.m. ET (the “Entry Period”). The University’s network computer clock shall be the official clock for the Event.
- Eligibility. Eligibility for a prize is limited to natural persons who are (a.) over the age of eighteen (18), (b.) U.S. citizen or lawfully present in the U.S. pursuant to a valid non-immigrant visa, and (c.) are eligible to participate in Wright State University’s SSI survey. Without exception, no individual who is involved in the conduct of the Event (and that individual’s spouse, parents, children, siblings, and any other person with whom the individual co-habitats) is eligible to win a prize. Except as specifically provided to the contrary below, University employees/trustees (and their immediate family members, as described above) are not eligible to win a prize. Full-time University employees who are also full-time students, and part-time University employees who are also part-time students, are eligible to win a prize.
- How to Enter. During the Entry Period, an eligible individual may enter the Event through either of the following methods. The University will not consider any entry that is illegible, misdirected, late, incomplete, false, fraudulent, forged, postage-due, lost, or generated automatically (by any bot, macro, or other device). Each person may enter the Event only once.
- Survey Entry. Select individuals may receive an email link to to participate in the Student Satisfaction Inventory (SSI) Survey as a Wright State University student. Each eligible individual who completes and submits the online survey will be automatically entered in the Event for the contest associated with that particular survey.
- Free Entry. Any eligible individual who does not wish to participate in the survey, but who wishes to participate in the Event, may enter by mailing (sufficient postage pre-paid) a 4”x 6” postcard clearly stating the individual’s name, address, mailing address, daytime phone number, and email address, along with a statement describing the contest to which the entry applies, to Wright State University Dayton Campus SSI Survey Sweepstakes, c/o Office of Institutional Research & Effectiveness, Wright State University, 3640 Colonel Glenn Highway, Dayton, Ohio 45435. All mail-in entries must be received at the address above during the Entry Period.
- Prizes. Prizes are non-transferable. No substitutions will be made, except that at the University’s sole option, the University may substitute any prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winners are solely responsible for all taxes associated with any prize. Limit one (1) prize per entrant. The prize for the Event is one 9th Generation 10.2-inch iPads Wi-Fi 64 GB Space Gray.
- Drawing and Notification. The University shall randomly select one (1) winner for the Event. The drawing shall occur at the Office of Institutional Research & Effectiveness at approximately 3 o’clock pm on May 15, 2024. The entrant who's names are selected shall only be a presumptive winner until the individual’s eligibility is confirmed by the University. The University will use reasonable efforts to notify the presumptive winners promptly after the drawing. One (1) phone call to the presumptive winner’s telephone number on file, and one (1) email address to the presumptive winner’s email address on file, shall be deemed reasonable. The University will provide claim information at the time of notification. The University reserves the right to disqualify any presumptive winner who does not claim his or her prize within seven (7) days of notification, or who fails to provide a properly executed affidavit of eligibility upon the University’s request, or who fails to provide information reasonably necessary for the University to comply with all applicable laws (including without limitation providing information necessary to complete any applicable tax forms), or who fails to prove his or her identity in a form reasonably satisfactory to the University, or whose entry is determined to have been not in strict compliance with these Official Rules. If a presumptive winner is disqualified, the University will randomly select a new winner from the same pool of eligible entrants as the disqualified winner. The University shall have the option to terminate the Event without awarding a prize if no winner successfully claims his or her prize after three (3) re-drawings.
- List of Winners. A list of the winners will be provided upon request for at least thirty (30) days after the end of the Entry Period. To request a list of winners, send a self-addressed, adequately stamped, business envelope to Wright State University Dayton Campus SSI Survey Sweepstakes, c/o Office of Institutional Research & Effectiveness, Wright State University, 3640 Colonel Glenn Highway, Dayton, Ohio 45435.
- General Conditions. The University may, in its sole option, cancel, suspend and/or modify the Event, or any part of it, if any fraud, technical failures, human error or any other factor impairs the integrity or proper functioning of the Event, as determined by the University, in its sole discretion. In such event, the University, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any or all of the prizes offered herein. The University reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Event, or who the University determines may be in violation of the Official Rules. Any attempt by any person to deliberately undermine the legitimate operation of the Event may be a violation of criminal and civil law, and, should such an attempt be made, the University reserves the right to seek damages from any such person to the fullest extent permitted by law. The University’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. The University reserves the right to immediately terminate the Event, with or without awarding any prizes, if the University determines that any part of the Event is, may be, or becomes illegal or inconstant with any applicable laws, regulations, policies, instructions, or guidelines.
- Retrieval and Use of Information. As a condition of participating, each individual who submits an online survey consents to the University’s retrieval of biographical information about the individual from the University’s databases—including without limitation name, address, email address, telephone number, sex, years of application or enrollment, and enrollment status at the University or other institutions—and to the association of that information with the entrant’s survey responses. The University will not sell any entrant’s contact information to any third-parties. However, the University may use such information, in whole or in part, in records that are or may become “public records” under applicable law.
- Release.
- As a condition of participating in the Event, each entrant agrees, individually and on behalf of his or her respective heirs and assigns, to release and hold harmless the state of Ohio and Wright State University, including their respective trustees, officers, officials, representatives, attorneys, insurers, affiliates, and employees (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Event or receipt or use or misuse of any prize.
- By entering through the submission of a survey, each entrant knowingly, voluntarily, and irrevocably grants to the University an unlimited, worldwide, royalty-free license to use any information provided by the entrant, or associated with any entrant’s responses to the survey.
- Limitations of Liability. The Released Parties are not responsible for: (a.) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Event; (b.) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c.) unauthorized human intervention in any part of the entry process or the Event; (d.) technical or human error which may occur in the administration of the Event or the processing of entries; (e.) late, lost, undeliverable, damaged or stolen mail; or (f.) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant’s participation in the Event or receipt or use or misuse of any prize. If for any reason an entrant’s entry is determined to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is another entry in the Event, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the University reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
- Disputes. Except where prohibited, Entrant agrees that: (a.) any and all disputes, claims and causes of action arising out of or connected with this Event or any prize awarded shall be resolved individually, without resort to any form of class action, in a court of competent jurisdiction; (b.) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Event, but in no event attorneys’ fees; and (c.) under no circumstances will any entrant be permitted to obtain awards for, and by entering each entrant waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and the University in connection with the Event, shall be governed by, and construed in accordance with, the laws of the State of Ohio without giving effect to any choice of law or conflict of law rules.
