COVID-19 Vaccination Giveaway

  1. Details. To promote COVID-19 vaccination within the Wright State University (the “University”) community, the University administration is sponsoring this COVID-19 Vaccination Giveaway (the “Promotion”) subject to these Official Rules.
  2. Entry Period. The “Entry Period” will begin on or about September 24, 2021, and end promptly at 11:59 P.M. (E.S.T.) on November 22, 2021. The University’s network computer clock shall be the official clock for this Promotion.
  3. Eligibility. A “Participant” is any person who enters the Promotion. The Promotion is open to all “Eligible Participants.”
    1. An “Eligible Participant” is a Participant who is a natural person, over the age of eighteen at the time of entry, and also:
      1. Is a University employee or student;
        1. A “University employee” is a person who is employed by Wright State University on the date of entry, and who remains employed through the end of the Entry Period. Emeritus faculty are eligible only if substantially engaged during the Entry Period in paid or volunteer (a.) teaching in official University courses, or (b.) research on University-sponsored or University-sanctioned research projects. Student-employees who meet the definition of a “University Student” are not eligible under this section.
        2. A “University student” is a person who is enrolled in an official Wright State University course on the date of entry, and who remains continuously enrolled in at least one official Wright State University course through the earliest of the last day of the Entry Period, or the last day of Fall Semester, 2021 (per the University’s Academic Calendar).
      2. Physically present in Ohio on the date of entry.
      3. Not a member of the University’s Board of Trustees, the President’s Cabinet or Council, the University’s COVID-19 Taskforce, or other University personnel directly involved in planning or conducting the Promotion. Parents, children, siblings, and household members of the individuals identified in this Section are also ineligible.
      4. Has received the last required dose of a COVID-19 vaccine that is approved for use in the United States by the FDA, or internationally by the WHO. Individuals who have participated in or are participating in bona fide COVID-19 clinical trials for other vaccines are also eligible. 
      5. Legibly submits an Official Entry, using methods specified in these Official Rules, which the University actually receives during the Entry Period.
    2. The COVID-19 Vaccine is not required by the University or the state of Ohio. Otherwise Eligible Participants who wish to participate, but who cannot be vaccinated, such as those for whom a COVID-19 vaccine is medically contra-indicated, should contact deanofstudents@wright.edu.
  4. Entry. During the Entry Period, an Eligible Participant may enter the Promotion through either of the following methods. The University will not consider any entry that is illegible, misdirected or not received by the correct University office (for any reason), late, incomplete, false, fraudulent, forged, postage-due, lost, generated automatically (by bot, macro, or other device), or that otherwise fails to conform strictly to the Official Rules. Limit one entry per person.
    1. Electronic Entry. The University has established an online portal through which University students and employees may provide information regarding their COVID-19 vaccination status. The online portal is available at: Med+Proctor, a secure medical third-party website. Upon successfully submitting the required information, and uploading a clear image of the front and back of the Participant’s COVID-19 vaccine card, the University’s online portal will provide a link to an online Promotion entry form. To enter, Eligible Participants must (a.) provide their vaccination information through the portal, and then (b.) submit a completed entry form using the online portal. Entries received by this method will be automatically entered into the Promotion.
    2. Other Entry. The University may, in its sole discretion, accept an alternative entry from any otherwise Eligible Participant who cannot successfully enter using the Electronic Entry method above. Contact deanofstudents@wright.edu for alternative entries.
  5. Prizes. Prizes are non-transferrable. No substitutions will be made, except that the University shall have unlimited discretion to substitute any prize for one of equal or greater value if, for whatever reason, the designated prize should become unavailable. Winners are solely responsible for payment of any and all taxes associated with any prize. Each Eligible Participant is limited to a maximum of one prize from the Promotion. Prizes will be awarded to Eligible Participants on the basis of random drawing only, and no further prizes will be awarded once all prizes have been awarded and successfully claimed. Prizes shall consist of the following:
    1. Student Prizes. Prizes for eligible students are: $2,500  Prize (Visa card or equivalent) (2 winners); $250 Barnes & Noble Gift Card (2 winners); $100 Barnes & Noble Gift Card (10 winners); 1 Semester WSU Student Parking Pass (10 winners); $25 Starbucks Gift Card (20 winners); Use of a Nutter Center Box with $250 Catering Credit at WSU Men’s Basketball game (no alcohol, game to be selected by the University) (1 winner); Use of a Nutter Center Box with $250 Catering Credit at WSU Women’s Basketball game (no alcohol, game to be selected by the University) (1 winner); Use of a Nutter Center Box with $250 catering credit at Nutter Center Event of the University’s choice (1 winner). A Participant selected for a prize will be ineligible for all other prizes.
    2. Employee Prizes. Prizes for eligible employees are: $1,000 Prize (Visa card or equivalent) (5 winners); $100 Barnes & Noble Gift Card (5 winners); 1 Yearly WSU Faculty/Staff Parking Pass (5 winners); $25 Starbucks Gift Card (10 winners); Use of  a Nutter Center Box with $250 Catering Credit at WSU Men’s Basketball game (no alcohol, game to be selected by the University) (1 winner); Use of a Nutter Center Box with $250 Catering Credit at WSU Women’s Basketball game (no alcohol, game to be selected by the University) (1 winner); Use of a Nutter Center Box with $250 catering credit at Nutter Center Event of the University’s choice (1 winner); 8 Hours Vacation (5 winners); $200 Dayton/Columbus/Cincinnati Merry Maids Gift Card (1 winner). A Participant selected for a prize will be ineligible for all other prizes.
    3. The University shall have the right, but not the obligation, at any time and in its sole and absolute discretion, to add additional prizes to the Promotion. The University reserves the right, in its sole and absolute discretion, to select and/or change the prize(s) to be awarded during the Promotion, and/or to end the Promotion, before all prize winners are drawn.
  6. Drawings and Notification. At the time of drawing, the University will first determine the order in which prizes will be awarded. Then the University will randomly select one winner for each prize; employee prizes will be awarded in order according to the list of employee entrants, and student prizes will be awarded according to the list of student entrants. When all prizes have been successfully claimed, no further prizes will be awarded to any remaining entrants who have not been selected as winners. The drawing shall occur at University Hall, 3640 Colonel Glenn Highway, Dayton, Ohio 45435 on or about noon on December 1 ,2021. Each Participant whose name is drawn for a prize shall be a presumptive winner only unless and until the presumptive winner is determined by the University to be eligible under these Official Rules, to have fully complied with these Official Rules, and has successfully claimed their prize.
    1. The University will attempt to contact each presumptive winner using at least one of the following methods: (a.) an email to the presumptive winner’s official @wright.edu email address; or (b.) a telephone call to the number provided by the Participant at the time of entry. Initial notification will occur within one week of the drawing. The University shall be under no obligation to make further attempts to notify each presumptive winner, and the timing and method of any such further attempts shall be in the University’s sole and absolute discretion. The University will provide claim information at the time of notification.
    2. The University may disqualify any presumptive winner who fails to claim their prize within seven days of the University’s initial attempt at notification. The University may also disqualify any presumptive winner who fails to provide adequate evidence or documentation of their identity and eligibility, and/or whose participation in the Promotion the University reasonably determines not to have been strictly in accordance with these Official Rules, or who is ineligible. If any presumptive winner is disqualified, the University shall draw an alternate winner for that particular prize. The provisions of these Official Rules applicable to presumptive winners are similarly applicable to alternate winners, if alternate winners are selected. If a prize is not successfully claimed after three re-drawings, the University may terminate the Promotion without awarding that prize.
  7. Claims & Verification.
    1. The University may require any winner to complete a claim form, the contents of which shall be in the University’s reasonable discretion. A claim form may require each presumptive winner to (e.g.) submit a notarized affidavit of eligibility, tax forms the University deems necessary or advisable, formal signed releases as provided elsewhere in these Official Rules, and other documentation the University deems reasonably necessary to conduct this Promotion under its operating policies and procedures.
    2. Each presumptive winner’s eligibility is subject to and contingent upon the University’s independent verification of the presumptive winner’s eligibility. As a condition of participating in the Promotion, each Participant unconditionally agrees to cooperate with and participate in the University’s eligibly verification, including by providing information and documentation reasonably deemed necessary or advisable by the University with respect to the presumptive winner’s identity, COVID-19 vaccination status, and other eligibility criteria under these Official Rules. A presumptive winner may be disqualified for failing to reasonably and timely cooperate with the University’s eligibility verification. If the University cannot verify a presumptive winner’s eligibly and compliance with these Official Rules within a reasonable period of time, it shall have discretion to disqualify the presumptive winner without further obligation or notification. Seven days from the date of notification shall be deemed a reasonable period of time for purposes of the University’s verification hereunder.
  8. List of Winners. A list of winners will be provided upon request for at least thirty days after the last day of the Entry Period. To request a list of winners, send a self-addressed, adequately stamped, business envelope to Wright State University, Office of Student Conduct, ATTN: COVID-19 Giveaway, 3640 Colonel Glenn Highway, Dayton, Ohio 45435.
  9. Release. By choosing to participate in this Promotion, each Participant agrees, individually and on behalf of their respective heirs and assigns, to release, indemnify, and forever hold harmless the state of Ohio and Wright State University, together with their respective trustees, officers, officials, representatives, attorneys, insurers, affiliates, and employees (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the Promotion, COVID-19 vaccination, access or use of COVID-19 vaccination information voluntarily uploaded by the Participant through the University’s designated online portal, and/or receipt and use of any prize awarded hereunder.
  10. Limit of Liability. The Released Parties are not responsible for: (a.) any incorrect or inaccurate information, whether caused by entrants/Participants, printing errors or by any of the equipment or programming associated with or utilized in the Promotion; (b.) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c.) unauthorized human intervention in any part of the entry process or the Promotion; (d.) technical or human error which may occur in the administration of the Promotion or the processing of entries; (e.) late, lost, undeliverable, damaged or stolen mail; or (f.) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from any entrant’s participation in the Promotion or receipt or use or misuse of any prize.  If for any reason a Participant’s entry is determined to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Participant’s sole remedy is another entry in the Promotion, if it is possible. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, the University reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.
  11. Publicity. As a condition of receiving a prize, the University may require each winner to sign a separate release providing irrevocable, express permission for the University’s use of the winner’s name, image, and/or likeness worldwide, in perpetuity, for purposes of advertising and trade, and such release shall be without further compensation, notification, or permission unless prohibited by law, in all media now known or hereafter devised. The University may provide each winner with a separate release upon notification that they have been selected for a prize, which release the winner must sign and return to the University as a condition of eligibility.
  12. Disputes. Except where prohibited, each Participant agrees, as a condition of participating in the Promotion, that the University shall have the right, in its sole discretion, to limit its maximum liability (if any) to the Participant arising from or out of any dispute pertaining to the Promotion, or the conduct of the Promotion, or the awarding or not awarding of any prize, or the University’s determination of eligibly/ineligibility or verification of the same, or otherwise arising under or touching upon these Official Rules, to the cash value of the lowest-value prize offered under these Official Rules. Each Participant acknowledges and agrees that in no circumstance shall the University be liable for any attorney fees, court costs, consequential damages (even if known), or punitive damages. Each Participant agrees that any such dispute shall be resolved individually, without resort to any form of class-action. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participant and the University in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Ohio without giving effect to any choice of law or conflict of law rules.  
  13. Void Where Prohibited.
    1. The Promotion is subject to all applicable laws and regulations, and void where prohibited.
    2. If it is determined at any time that all or any part of this Promotion is illegal, void, or unenforceable under applicable laws and regulations, the University reserves the right, in its sole option, to amend these Official Rules to conform the Promotion to applicable laws and regulations, or alternatively, to terminate the Promotion without further liability to any Participant.
    3. If the Promotion becomes illegal due to any legal, statutory, or regulatory change occurring on or after the beginning of this Promotion, the University shall have the right, in its sole and absolute discretion, to either modify these Official Rules to bring the Promotion into compliance with all applicable authorities, or discontinue the Promotion without further notice and without liability to any Participant.
  14. General Rules.
    1. Winners are solely responsible for the payment and reporting of taxes associated with their prize. All winnings may be reported to the appropriate tax authorities as required by law.
    2. Prizes may be offset by the winner’s past-due balance, if any, to the University and/or the state of Ohio.
    3. The University makes no warranty, guarantee, or representation of any kind concerning any prize (or any portion thereof) and disclaims any and all warranties, express or implied.
    4. As a condition of participating in the Promotion, each Participant agrees to be bound by these Official Rules.
    5. Entries that are determined to be fraudulent, false, forged, or otherwise unlawful may be reported to the appropriate law enforcement authorities. As a condition of participating in the Promotion, each Participant represents and warrants to the University that the vaccination information voluntarily uploaded by the Participant to the University’s designated online portal is true and correct to the best of the Participant’s knowledge and belief. Fraudulent reports of vaccination information may be addressed through appropriate University disciplinary action, up to and including expulsion (for students) or termination (for employees) and referrals to criminal law enforcement.
    6. Unless prohibited by law, the University reserves the right to extend the Entry Period at any time, and in its sole and absolute discretion, by posting a notice to that effect on its website in approximately the same location as it posts these Official Rules.
    7. Unless prohibited by law, the University reserves the right to amend these Official Rules at any time, and in its sole discretion—provided that the University shall not reduce the number or approximate value of prizes (unless the number, amount, or description of a prize is in error)—by posting a notice to that effect on its website in approximately the same location as it posts these Official Rules. Participants may request a current copy of these Official Rules at any time by sending a written request therefore, with a self-addressed, adequately stamped, business envelope to Wright State University, Office of Student Conduct, ATTN: COVID-19 Giveaway, 3640 Colonel Glenn Highway, Dayton, Ohio 45435. Requests for Official Rules will be accepted until thirty days after the drawing, or until all prizes have been claimed, whichever is later.
    8. By entering the Promotion, each Participant expressly authorizes the University to access and use, for the University’s official business, the contents of and information contained in the vaccination record voluntarily uploaded by the Participant to the University’s designated online portal.
